These Terms and Conditions form a binding contractual agreement between the traveler(s), customer(s), and/or purchaser(s) (collectively, "You" and "Traveler") and HaqTravel (USA) ("HaqTravel", "We", "Us", "Our") for Hajj and Umrah travel services. Please read this Agreement carefully before completing your booking.

Travel Agent Status

HaqTravel acts solely as a travel agent. We sell various travel-related products and services on behalf of numerous transport and accommodation service providers, including but not limited to airlines, hotels, and local Saudi Arabia ground transportation operators.

HaqTravel does not own, operate, manage, or control these independent suppliers of services and accepts no liability for their acts or omissions. HaqTravel's obligations to you are limited to making travel bookings on your behalf and arranging the relevant contracts between you and the travel service providers.

We have no responsibility for third-party services, nor do we have the authority to make any warranty or representation regarding their standard. All bookings are subject to the terms, conditions, and limitations of liability imposed by those individual travel service providers. Your legal recourse in the event of a dispute lies against the specific provider, not HaqTravel.

It is your responsibility to check the U.S. Government Travel Advisories for your intended destination at travel.state.gov/content/travel.html.

Pricing & Important Conditions

Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after full payment has been received, except for charges resulting from increases in government-imposed taxes or fees.

By proceeding with your booking, you expressly acknowledge and accept that:

  • Price increases occurring before full payment are your responsibility.
  • Price increases attributable to government-imposed taxes or fees after full payment has been made are also your responsibility.

All prices quoted are based on rates in effect at the time of quotation, including applicable foreign exchange rates, and are subject to change without notice.

Deposit & Final Payment

A minimum deposit per person is required at the time of booking, as agreed between HaqTravel and you. All deposits are non-refundable.

Final payment is required no later than the date agreed between HaqTravel and you prior to departure, unless otherwise stated in writing.

Important - Hajj Packages Final payment for Hajj packages is due as soon as possible following confirmation of your booking. Failure to make payment on time may result in the cancellation of your booking, and your place may be offered to the next person on our waiting list. HaqTravel accepts no liability for losses incurred as a result of late payment.

All airfares and ancillary services must be paid in full at the time of booking.

Should you wish to pay by credit card, you may be required to complete and sign a Credit Card Authorisation Form available on our website.

Cancellation Policy

Please be aware that most travel bookings and deposits are non-refundable. Cancelled bookings will incur charges that can be up to 100% of the total cost of the booking, regardless of whether travel has commenced.

Where HaqTravel incurs any liability for a cancellation fee or charge arising from a booking that you cancel, or that is cancelled under any circumstance, you agree to indemnify HaqTravel in full for the amount of any such fee or charge.

Change Fees

Once a travel booking has been confirmed and deposit(s) and/or full payment received, HaqTravel reserves the right to charge a non-refundable change fee of USD $50 per adult travel booking for date changes made at your request. This change fee is charged in addition to any fees levied by the relevant travel service provider(s).

Credit Card Transactions

If, for any reason, a travel service provider is unable to deliver the services for which you have contracted, your remedy lies solely against that provider, and not against HaqTravel.

In the event that payment has been made to HaqTravel by credit card, you agree that you will not seek to charge back your payment to HaqTravel. If a chargeback is initiated, you agree to indemnify HaqTravel against any resulting costs, including but not limited to legal fees incurred in recovering any amounts charged back by your credit card company.

If your credit card is declined at the time of payment, you guarantee that you will settle any outstanding amounts owed to HaqTravel via direct bank transfer or cash immediately.

Please note: the credit card holder must be a travelling passenger on the relevant booking.

Travel Protection (Insurance)

For your protection, HaqTravel strongly recommends that all travelers purchase comprehensive trip cancellation and travel accident insurance prior to departure. This is particularly important for Hajj and Umrah travel given the nature and logistics of the journey.

No description of insurance made by HaqTravel to you constitutes a binding assurance or promise regarding that insurance. HaqTravel is not an insurance company and bears no responsibility for the submission, payment, or adjustment of any insurance claims. Any claims must be submitted directly to the relevant insurance company as identified in your policy documentation.

Responsibility & Liability

HaqTravel will always endeavor to ensure your travel arrangements are satisfactory. However, HaqTravel and its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and assigns do not own or operate any entity that provides goods or services for your travel, including without limitation lodging facilities, airlines or other transportation companies, guides or guide services, local ground operators, food service providers, or organizers of optional excursions. All such persons and entities are independent contractors and are not affiliated to HaqTravel.

HaqTravel is not liable for any negligent or willful act or failure to act on the part of any travel service provider or any third party. Without limitation, HaqTravel is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services, whether resulting from:

  • Acts of God or force majeure
  • Illness or disease, including COVID-19 or other pandemics
  • Acts of war, civil unrest, insurrection, or revolt
  • Criminal or terrorist activities of any kind
  • Overbooking or downgrading of accommodations
  • Mechanical or other failure of aircraft or other means of transport
  • Any failure of any transportation mechanism to arrive or depart on time
  • Strikes or other labor activities

Certain foreign facilities or amenities, including air conditioning in hotels and public spaces in Saudi Arabia, may not meet U.S. standards. If, due to weather, flight schedules, or other uncontrollable factors, you are required to spend additional nights at your destination, you will be solely responsible for your own hotel accommodation, transfers, and meal costs.

Baggage is entirely at the owner's risk. Under circumstances where liability cannot be excluded by law, such liability is limited to the value of the purchased travel arrangements. You specifically agree that HaqTravel is not liable for any consequential loss or damage.

Passports & Visas

All individuals departing from the United States must be in possession of a valid passport. Please ensure your passport is valid for at least six (6) months beyond your intended return date.

It is your responsibility to ensure you hold valid travel documentation, including but not limited to passports and visas, that meets the requirements of immigration and other government authorities at every destination. You are responsible for confirming visa and entry requirements with the United States Department of State or the relevant government agency of the country to which you are traveling.

Any fines, penalties, payments, or expenditures incurred as a result of documentation not meeting the requirements of the relevant authorities will be your sole responsibility.

REAL ID (Domestic U.S. Travel)

If you plan to use a state-issued ID or driving license to fly within the United States, it is your responsibility to ensure it is REAL ID compliant. For further information, please visit www.tsa.gov/real-id.

Travel Documents

Travel documents include, without limitation, airline tickets, hotel confirmation letters, visas, or any other document, whether in electronic or paper form, used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and restrictions, including being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees.

Travel documents cannot be transferred to another person. All airline tickets must be issued in the exact name of the passport or photo identity holder. An incorrect name on a booking may result in an inability to use that booking and its cancellation without refund.

Please reconfirm your flights directly with the airline at least 24 hours prior to departure. Any errors in names, dates, or timings on your documentation are your responsibility if HaqTravel was not advised of the correct details at the time of booking.

Health & Special Requirements

It is your responsibility to ensure you are fully aware of any health requirements, health advisories, vaccination requirements, and travel restrictions applicable to your destination, including those specific to Saudi Arabia for Hajj and Umrah pilgrimage.

HaqTravel is not responsible for providing you with this information. Travel carriers and local authorities at travel destinations may require specific health documentation, testing, or vaccination certificates prior to boarding or upon arrival. You may be denied entry onto your carrier and/or entry at your destination if you are unable to comply.

You must comply with all local government regulations at your destination. Additional costs arising from non-compliance are your sole responsibility. For up-to-date health guidance, please visit www.cdc.gov.

Flight Confirmation & Check-In

HaqTravel strongly recommends that all clients reconfirm exact flight times directly with the airline prior to departure.

Minimum check-in requirements
  • Domestic flights: at least 2 hours prior to departure
  • International flights: at least 4 hours prior to departure
  • All passengers must report to their departure gate at least 60 minutes prior to departure

Failure to comply with these requirements may result in the loss of your seat to another passenger, for which HaqTravel accepts no liability.

Baggage

Additional fees for checked baggage may apply. Please contact your airline directly or refer to its website for detailed information regarding its checked baggage policies. HaqTravel accepts no liability for baggage loss, damage, or additional charges levied by airlines.

Some countries require insecticide spraying of aircraft prior to a flight or during flight. For further information, please visit the Department of Transportation disinfection page at www.transportation.gov/airconsumer/spray.

Additional Fees & Taxes

Additional taxes and surcharges that cannot be pre-collected at the time of booking may be charged locally by hotels or other suppliers at your destination. These charges are your responsibility and are not covered by HaqTravel.

Refusal of Service

Service providers reserve the right to refuse service to travelers at their sole discretion, including but not limited to where a traveler:

  • Lacks proper documentation for the country of destination
  • Has a contagious disease
  • Is under the influence of alcohol, drugs, or narcotics
  • Manifests disruptive and/or unruly behavior

HaqTravel assumes no liability for any service provider's decision to refuse service.

Privacy Policy

HaqTravel is committed to protecting the privacy and confidentiality of your personal information in accordance with applicable U.S. data protection laws. Our full Privacy Policy is available on our website. By making a booking, you consent to the collection, use, and processing of your personal data as described therein.

Acceptance of Terms

You may acknowledge and accept these Terms by any of the following means, all of which constitute effective acknowledgement and execution of this Agreement:

  • Electronic signature
  • Handwritten signature
  • Email, text message, or other electronic communication confirming acceptance
  • Implied consent through your actions, including payment of any invoice and/or your use of services provided by HaqTravel or any related travel supplier

Governing Law & Jurisdiction

The construction, validity, and performance of these Terms, and any disputes between the parties, are governed by and construed in accordance with the laws of the State of Illinois, without giving effect to any conflict of law principles, and any applicable federal laws of the United States.

Both parties submit to the exclusive jurisdiction of the courts of the State of Illinois with respect to any legal proceedings relating to these Terms.
